Restoring - balancing at the “line”?
ZXNet echo conference «zx.spectrum»
From Andrew Savichev → To All 20 December 1997
Hi, All!
I will try to reconcile the warring parties in a different way...
Friends, let’s understand the terms.
Restoring (from recovery, restoration),
releasing (from implementation, implementation),
recovering (recovering) (from return, correction).
These are quite different areas of activity, IMHO :)
The Law “On the Legal Protection of Programs...” was written clearly without a look at Spectrum fans and collectors! Apart from “adaptation of programs”, there is nothing
at least somewhat close to the subject of the ongoing
discussion:(
And from the point of view of adaptation, all three Ps are absolutely illegal!
Therefore, we at relcom.comp.speccy have categorically banned the distribution of restaurant
programs, so as not to tempt fate. ;)
BUT!!!
There is a specific need for people to forgotten (and often undeservedly!) games...
From this point of view, what S. Novikov and other authors are doing is definitely a good deed!
And we can interpret this activity on the basis of the Copyright Law as the creation of derivative works! See Article 7.3
"Objects of copyright also include:
derivative works (translations,...,_processing_,...)" and further
"Derivative works are protected by copyright regardless of
whether the objects of copyright are works that have been altered...
or anotherprocessing"
And also Article 12.1
"The translator and the author of another derivative work enjoys copyright
right, provided that he respects the rights of the author of the work that has undergone
rework... or other processing"
This means, IMHO, the following... if I know the author... for example, the creative
group Step "ZN-1", and I want to recycle the toy (for example, convert
it into a dynamic one), then I am obliged to ask Yuri Matveev for consent to
this action.
Then, I must present him with my version of the game so as not to violate Article 9
of the Law “On the Legal Protection of Programs” “... the right to inviolability
(integrity) ... capable of damaging the honor and dignity of the author"
And to put it simply, then in the words of Salieri...
"It’s not funny to me when a painter worthless
It stains Raphael's Madonna for me..." A.S. Pushkin "Mozart and Salieri"
To summarize:
1) Restoring is an author's activity, but without the permission of living
authors - it is a rather "slippery" thing;
2) It is unlikely that the authors will object if the restorer does not distort or vulgarize their
creations, but does everything with talent... and if not, then trouble
will most likely be evidence of the “Salierism” of the author of the original
work, while the undoubted condition for the absence of crime will be
doublecopyright at work: the original author and the restaurateur;
3) the restaurateur is also an author! has the right to the second (C), his creation is also
protected by copyright, the financial reward should be divided
into two!
Have a good hunt everyone! Andrey AKA m@s/CENSUS GROUP Spb (CGS)

We will definitely reconcile. A hacker-restaurant on the Spectrum should not feel like a
criminal.

This does not justify anything.

That's right. There is only one way out - official copyright permissions.

Yesss! “Hackers are people too” (c) mine ;)
In general, it’s like this... There is documentary evidence not only of the frivolity of many Spectrum games, but also permission to modify them, use and
change ideas, characters, graphics and code.I have the permits in my hands, in English, and if we persuade Sergei Novikov to translate them (so that there are no discrepancies), then we will know what can be done and what definitely cannot be done... And if we talk to Sergei better, then it is possible that, with his help, we will be able to wrest permits from other Western authors, due to laziness or misunderstanding not
"let loose" their Spectrum games ;)
AS> Happy hunting everyone! Andrey AKA m@s/CENSUS GROUP Spb (CGS)

And not only.
“Hackers are not only people” (c) mine.
But what are you trying to sell me here then?

How about throwing them into the echo?

DG> cannot be done...
:)))))) No, it won’t work that way. Original text, please.
Good luck! Evgeny.
