From Andrew Savichev To All 22 January 1998

Hi, All!
Hello, Roman!

> AS> please distribute and collect signatures on ZXNET.
>The idea is interesting, but you were a little hasty with the collection of signatures - the law has not yet been
>established, for now it only needs to be discussed.
It was a reaction to pirate maneuvers around the ChW... i.e. such a Law should have actually been discussed and adopted yesterday... but I’m ready to discuss it if
of course there are “opaque” points.

>In general, I’ll react a little here to some points. Those who
>satisfy me - I skip it.
O'k.
>
> AS> 5. Everywhere and everywhere try to form a favorable attitude

> AS> Spectrum, without “attacking” other platforms;
>Quite a difficult point - especially due to the dominance of pussies. Writers will
>treat Speccy like an outdated toy (at least those
>those with whom I talked think so. They also tried to make fun -
>make Warcraft on Speccy. Like I did thembroke it off by talking about CV (then he also showed a demo).
I already sent a long article about this today and I don’t want to repeat it.
Believe me, the “aggressor” always meets with an intuitive rebuff among the masses.
See. In films, the hero kills the antihero, as a rule, after he has shown his “rotten essence” to everyone. Why? - Yes, because it is impossible for a person to kill a person, it is a sin! As soon as “the one who raises the sword, let him die by the sword”
By hitting a person, you set society against yourself,
“running on pussy” ...is ridiculous, funny...but to explain to people _who_ they
turn into with the help of pussy is already a good thing.

>This is actually the most controversial point. First of all, you still can’t kill all the pirates.
Were you ever boycotted in class? ;)By the way, it gets on your nerves... our world is not that big. In the big city of Moscow (and in the big city of St. Petersburg) all the spektrumists can be gathered in the square - so, in principle, you can get acquainted with everyone in a day :) ... Well, not in a day, but in a couple of months for sure. And in other cities there is even less... and many traders know
many of their clients and so on. Those. in principle, if you take up this matter energetically
then in a year you can “overwhelm” the pirates, no matter what.
But that’s only if all the people rise up.
After all, the pirates rely on “wild” traders, and they, in turn, on “wild” users.
It is easy to block the distribution channels of new software for both of them, if
those who bought the licensed version WILL NOT GIVE it away to hacking.
This is what I proposed to Slava. He could mark versions of programs intended
for distributors with unique codes, and he would keep a program for quick
identification.
Let's say we sell a batch of N - nnn, and then we see the code nnn in the illegal
version. Everything is clear, the “leak” occurred through one of the ten buyers
of this distributor.
If we take it to the full “absolute”, then each copy sold must be equipped with
such a marker. All copies will be unique, but a pirated copy will go
under a certain number(s), and enoughDistributors should write down to whom they
sold the floppy disk under number nnn AND THAT'S ALL! The noose around this citizen's neck is tight!

>Depriving them of software is also difficult, and depriving them of frivolous software is
>this is perhaps too much. Perhaps the following solution is possible - hackers and
pirates are also people, they have at least some kind of conscience and reason, yes they do.
They will become people when they “give up”, but for now, excuse me, I don’t understand how people
can, with manic persistence, file down the branch on which they are sitting?

>The idea is simple - in each new program, do a little appeal to hackers -
>do not distribute the broken version of the program (even among friends) for
>a month (or more) after the release of the program. After this, hackers
are allowed to trade hacks.
If they want to trade, then why don’t they contact the author?
If they want to somehow improve the program, make, for example, corrections,
add something, then why don’t they again contact the author.
I think we can always agree on such forms of cooperation.
For example: CGS wrote a new game, and Brain Wave found how it greatly improve
and CGS wrote about it, I think in this case we will even give you the source
and, in principle, ask for a very small amount if you greatly improved
our development. In general, everything depends on the objective contribution and the authors will always
be ablearrange. So isn’t it time for hackers to learn to negotiate with the authors
and not fight with them, but to cooperate fruitfully.
Instead of breaking the executable code, make their own improvements to the source code,
instead of destroying - create together! :)

>Of course, if a product is declared frivolous
>it is advisable to suspend trading and distribute the program to everyone.
Otherwise, this is simply a crime against buyers.
Traders need to understand the following: all they can get from the sale is
the cost of the floppy disk + their costs for copying (unprotected floppy disks) and
protection, stickers, advertising, etc. + extortions from authorities, racketeering, landlords +
trade margins.
If the author has not specified the volume in the license, i.e. gave a floppy disk with a distribution kit, so that you sold no more than N copies and took m rubles from you for it, then you can “spread” the reward paid to him on an arbitrary
number of floppy disks, but if the number of copies is agreed upon, then you simply add m/N rubles to your costs and take (depending on demand) up to 15%
of the total cost. If the “players” in your place play by the rules (authorities,
landlords, bandits) and if you have foreseen the demand, then you will not be “out of luck.”
But if you have a mess - and ends do not meet, and you have to earn money at all costs, this is where it begins"chemistry" with prices.
And it turns out that you pay everyone (not forgetting yourself), and the author "is a piece of cake." Moreover, “wild traders” bring down the price. If your competitors had been heated up by the court just once, so that they wouldn’t be bothered or they would be “sorted out” - then next time they wouldn’t lower your prices. And so - a vicious vicious circle.
What is the way out?
And a simple one: since the Law does not work, the author must think through in detail a plan
for cooperation with traders.
Let's say, send the source code (preferably in the form of a library with an interface) to
the trader. The trader forms a “support group” around himself, or vice versa
the local creative group itself finds the trader. And then they modify the program so much that they always have a more interesting, more complete version than their competitors. Those. The "civilized" team is always half a length ahead of the "savages". You can also indicate in the advertisement that in a given place
the buyer will always receive a more interesting product, supported by the author.
Ie. pirates must be destroyed organizationally and economically :)
If such a group itself “lights up” by distributing “leftist” copies,
then the author will simply no longer deal with them.
