Crystal Dream

ZXNet echo conference «zx.spectrum»

From Stanley Ivanenko To All 5 March 1998

Here I am talking to you again, All.

Attention breaking news!

In view of the unpleasant story with ChV-2, the Crystal Dream group was reorganized.
Eugene and Rocknilek dropped out of it! All joint projects with these people have been
redistributed! In view of this, the group requires coders to work together.
All suggestions in netmail.

With a fleeting smile, Stanley.

You must be delusional? Let's say if we broke the ChV (and we could
do it;) and spread it to several cities, then what would you do to me???
Would you stop messing with me in the echo? Wrote a huge article about how bad we are?! And what? Read it, forget it. So far, no one bears legal responsibility for non-compliance with copyright on Speck. So it’s not clear what kind of punishment you
mean. I hope you are not going to implement the plan of Joker from Kharkov, who promised to ride the gang in a minibus if someone breaks the MK? :) But here you don’t know who you’ll run into ;)

EM> after all, the damage has already been done, you can’t fix it... How is Slava?
^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^^ this is, of course, very bad, but it’s worth
taking into account that the market for Spekov’s software is still a market and it has the same market conditions laws, with all the + and -, and most users don’t know what you’re talking about here
and, in principle, they don’t care, they need something new, and cheaper! And
no one is interested in your bazaars about honesty and hackers. So guys, talk about the same thing as much as
you can, because for now there will beCOMMERCIAL SOFTWARE, THERE WILL BE HACKERS - I already wrote on this topic. But it is not yet possible to punish hackers! The only thing that imho can have an effect on hackers is if
traders refuse to buy (distribute) broken software, in this case you can
achieve something practical, and the rest is empty chatter.

And even more so, I would not attack subj'eviks. After all, people already took a heroic step, expelled several of their members from the ranks of the group, so imho
they punished themselves anyway. And in principle, who are we to judge them???

P.S.: If someone had come at us about this, they would have torn our heating pads! (for the future ;)

From Andy Harchenko To All 12 March 1998

Having sat down at the keyboard, I decided to draw a letter for you Stanley.

We have been reading here for a long time attacks on Crystal Dream about the ChV and we are surprised at how you
sit silently and wipe away your tears, making excuses right and left, like you have already kicked them out and that you and the others are not guilty. Firstly, how can you be kicked out of the group because of this? Everyone makes mistakes and you, as an organizer, could prevent, understand, so that this does not happen again. After all, you can interest people in making
something of their own, rather than wasting time breaking CVs and making money on your
product. And in general, why are you justifying yourself to all sorts of people who have nothing to do with this? The only person with whom you can have a serious
battle is Slava, so he really has every right to attack you, and
the rest, as they say, just let him get promoted. So you, as a group, must
have your own dignity, and you, as an organizer, must be able to give a kick to everyone who
offends on the honor of the group. So don’t pay attention to stupid attacks from
others.

Respectfully: <<>>

An interesting thought... By the way, in Russia (as, by the way, in Ukraine)
laws on copyright have been adopted. Which, among other things, protect
the rights of authors to programs. And in order for the program to be protected,
it is enough for there to be a small icon there, in the form of the letter c in a circle, “copyright” is called...

To be honest, I’m not an expert in this matter, but as far as I know, a program with such an
icon (so that it is not just part of the graphics) must be registered with some
department, and for this you need to compile a bunch of documents. information and in my opinion even

A good option is to sell copyrighted copies until a
truly competing hack appears. Then switch to the distribution kit, so that the trader
could reduce the price below the pirated price and, thereby, stop the spread of the hack.
There are a lot of “buts” here, at least if the trader deliberately starts a rumor that there is a hack
to get rich. With CV, at least, everything is clear, I can even
send the Lugansk hack, if necessary, I can get it.

Actually, a distribution kit is more profitable for a trader, but in this case the author will not
collect a large amount :(

Well, firstly, I didn’t know then that he was an official trader, and secondly, I was offended by his proposal to punish. I just think that every person should deal with their problems themselves, and not rely on others. They spoiled your CD, so
go to them and sort it out, and imho there is no need to throw such calls into the echo.
And if I did offend him or you or anyone else, then I offer my sincere

From Andy Harchenko To All 21 March 1998

I’m very interested in how many % of the total amount of software Zhenya Safronov has are
authored programs? After all, there are definitely a couple of dozen discs that were obtained through dishonest means, and according to your reasoning, how many groups should have died for this, because when you received money for these discs, you probably didn’t think that you had to go and deal with those who helped you replenish your wallet! The conclusion that follows from all this is that first you need to realistically assess the situation, whether you are fair and pure enough to administer justice to others. After all, we are all right, as long as it is in our interests!

I hope you guessed that it didn’t come out without my help and not without
reason. After all, you stood up for Zhenya and did what we did, our
Spectrum duty was to support CD in the current situation. After all, we must
maintain the morale of the types, no matter what they are.

I feel like you can’t figure this out without 100 grams :)

From Andy Harchenko To All 21 March 1998

I believe that as long as you didn’t give them this money, they didn’t lose anything. How can I
lose something that I don’t have??? If everything really turns out the way you described above, then there will be a mess with the software! When people receive a new program, they will break it
and mailing of pirated copies to cities will begin and imho so traders
will die early, so we hope for a good attitude of traders towards
software producers. It would be possible to come up with something simpler to teach the
CD a lesson. After all, you are touching with your “boot” innocent kidneys that are not involved in the crime. So try to quietly sort things out among yourselves and not pour all the dirt into the echo, so as not to create conflict situations! And then some people
lose the desire to hang on the Spectrum due to instability with the software. And all this
instability is due to little skirmishes like yours, so STOP
GUYS!!!!!!!!!!!!

In Ukraine? Is the dispute serious? Is the amount of the claim substantial? Are the claims justified? Is there
legally acceptable evidence?

Then, guys, you don’t need to read the laws, but go to a good lawyer. Prepare a lot of money for the future (about $100 to start) and stock up on endurance and patience. The lawyer will tell you what documents need to be collected, what to do,
who to write and what.

I had direct dealings with this, so I advise you to sit down and _well_
think about whether you are ready to spend your time and your money (which, quite
possibly, will not be returned to you), while the probability of success for an ordinary citizen is
about 5% (But if it does come to a civil court, the facts will be collected and
there will be a competent lawyer - about 95%)

If the goal is simply to obtain moral satisfaction, if I were you,
perhaps I would choose other methods that are more effective in the gangster country in which
we live...

product, employee of the KGS Trading Department and my companion,
EM>> finally!
AH> Well, firstly, I didn’t know then that he was an official trader, and secondly
AH> I was offended by his proposal to punish. I just think that each person should deal with their
AH> problems themselves, and not rely on
AH> others. They spoiled your CD, so go to them and sort it out, and imho
AH> there is no need to throw such calls into the echo. And if I did offend him or you or
AH> finally offended anyone, then I offer my sincere apologies, I’m just
AH> an emotional person, especially since after pneumonia, I spent a whole
AH> at home for a whole
AH> month, just talking to fido and talking, you know
AH> I was in a disgusting mood. Well, now I seem to be getting better. And
AH> the joys of life make me happy again :)

Okay, there are no more suggestions :) And before you answer, first get to know
at least a little about the person, Ok? By the way, in his origin it is written who he
is :).

From Eugene Malkov To All 23 March 1998

I greet you from the bottom of my heart, George!

Sat Mar 21, 1998, George Shepelev squeezed his keyboard, hoping that the following words would reach Eugene Malkov
:

GS> 2) authors whose works were first published in another
GS> country and within thirty days after that published in Ukraine-
GS> regardless of citizenship and permanent place of residence author;

GS> Next question, please. ;)

How can a program be considered published? We are not registered as
distributors of copyrighted software with the tax and other services. Therefore, according to the law, they did not have the right to distribute? Then it turns out there was no publication?

From Eugene Malkov To All 23 March 1998

AH> Safronova, original programs?

100%, not counting frivolities. We have very little software, but everything was obtained in an honest way. We already had a flame about this, come to us and check it out.

AH> your wallet! The conclusion that follows from all this is that you first need to really
AH> evaluate the situation, whether you are so fair and pure as to administer
AH> justice over others. After all, we are all right, as long as it is in
AH> our interests!

We are pure in relation to the authors! Besides, we ourselves are the authors, albeit not yet
published programs.

AH> I hope you guessed that it wasn’t without my help that it came out and not without
AH> thoroughly. After all, you stood up for Zhenya and did what we did,
AH> our Spectrum duty was to support CD in the current situation. After all
AH> it is necessary to maintain the morale of the types, no matter what they are.

Well, it would be better if you took the side of Glory. We got into trading
exclusively in order to support the authors, and if by supporting one,
we infringe on another, then the one we support is more honest in relation to others!

AH> I feel like you can’t figure it out here without 100 grams :)

Bring it :) True, I don’t drink anything stronger than beer, but the main thing is participation! :)

From Eugene Malkov To All 23 March 1998

EM>> full purchase of all rights, if everything is in order with the ChV. Now
EM>> all they have to do is bite their elbows :(

AH> I believe that as long as you didn’t give them this money, they didn’t lose anything.
AH> How can I lose something that I don’t have??? If it really was like that all

$100 was in their pocket - I keep my word!

AH> instability with the software. And all this instability is because of such
AH> little skirmishes, like yours, so STOP IT GUYS!!!!!!!!!!!!

What a _little_! (sorry for the expression)
FLOOR is leaving the software world!!! does not judge and does not attack. We ignore :)
AH> After ignoring the bad sectors, the program does not work!!!!
AH> The phrase has a global meaning, think about it!

So far, one sector has been ignored, with not very valuable information! But if this
“floppy disk” continues to crash the entire “system”, then the “disk drive” will have to
format it!

From Eugene Malkov To All 23 March 1998

TY> In Ukraine? Is the dispute serious? Is the amount of the claim substantial? Are the claims justified?
TY> Is there legally acceptable evidence?

There is no dispute yet, but a commercial project is about to come out and we want to know how
the state can protect us!

TY> Then, guys, you don’t need to read the laws, but go to a good lawyer.
TY> Prepare a lot of money for the future (about $100 to start) and
TY> stock up on endurance and patience. The lawyer will tell you what documents
TY> need to be collected, what to do, who to write to and what.

I know this very well, I was involved in some other matter.

TY> I had direct dealings with this, so I advise you to sit down and _well_
TY> think about whether you are ready to spend your time and your money (which,
TY> quite possibly, will not be returned to you), while the likelihood of success for
TY> an ordinary citizen - about 5% (But if it does come to a civil court
TY>, the facts will be collected and there will be a competent lawyer - about 95%)

A lawyer will be there if you offer to half the amount of the claim - in this case
the case is usually in a hurry to be successful :)

TY> If the goal is simply to get moral satisfaction, if I were you
TY>, I would probably choose other methods, more effective in
TY> the gangster country in which we live...

We are against violence! At leastпока!

From Eugene Malkov To All 23 March 1998

RM> I also think that it’s not a good idea to contribute to the demise of the group. We need
RM> to resolve
RM> this conflict in favor of Spectrum (read - the authors, and traders, and
RM> users).

We will buy the next project from them (of course, if the project is valuable).
But Smagli3 - alas...

From Eugene Malkov To All 23 March 1998

I greet you from the bottom of my heart, Vyacheslav!

Mon Mar 23, 1998, Vyacheslav Mednonogov squeezed the keyboard, hoping that the following words would reach Andy
Harchenko:

AH>> I’m very interested in what % of the total amount of software Zhenya has
AH>> Safronov’s own programs? After all, there are definitely a couple of dozen disks
AH>> that were obtained through dishonest means

VM> One redeems the other ;)))

You're wrong! There is nothing for my wife to bathe!

From Andy Harchenko To All 23 March 1998

AH>> Yes, I think they already got theirs, although this is your
AH>> business, but the group can
AH>> be bent, and imho not very good.

From Eugene Safronov To All 24 March 1998

AH>> I’m very interested in how many % of the total amount of software Zhenya
AH>> Safronov owns are copyrighted programs? After all, there are definitely a couple of dozen disks

From Tim Yunaev To All 25 March 1998

TY>> justified? Is there legally acceptable evidence?
EM> There is no dispute yet, but a commercial project is about to be released and we want
EM> to know how the state can protect us!

No way. You can only protect yourself. In the sense that the state organs will not fuss
to prove someone else’s guilt at all (and they will
put a spoke in your wheels).

EM> How can a program be considered published? We are not registered as
EM> distributors of copyright software with tax and other services.
EM> Therefore, according to the law, we did not have the right to distribute? Then
EM> there was no publication?

Let's look at the terminology of the Law...

=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=

Section I
GENERAL PROVISIONS
Article 1. Rights protected by this Law
This Law protects the personal (moral) and property rights
of authors and their legal successors associated with the creation and use
of works of science, literature and art (copyright), and the rights
of performers, producers of phonograms and broadcasting organizations (related
rights).
Article 2. Legislation of Ukraine on copyright and related
rights
The legislation of Ukraine on copyright and related rights consists
of this Law and other legislative acts of Ukraine that protect
personal (non-property) and property rights of persons who have copyright and related rights.
Article 3. Application of the rules of an international treaty
If an international treaty to which Ukraine is a party
establishes others rules than those contained inlegislation of Ukraine on copyright and related rights, then the rules
of the international treaty apply.
Article 4. Definition of terms
In this Law, terms are used in the following meaning:
author - an individual whose creative work created the work;
. . . . . . . . . . .
database - a collection of data, materials or works in a
machine-readable form;
. . . . . . . . . . .
exclusive right - a right when no person, other than the one who has copyright or related rights, can use the work without having the appropriate permission (license),
except for the cases established by this Law;
. . . . . . . . . . .
reproduction - the production of one or more copies of a work or phonogram in any material form, including sound and video recordings, as well as the recording of a work or phonogram for temporary or permanent storage in electronic (including digital), optical or other form that is read by a machine. A copy is the result of some kind of reproduction of a work; leasing is the transfer of ownership of an original or a copy of a work or phonogram for a certain period of time with the aim of obtaining direct or indirect commercialbenefits;
computer program - a set of instructions in the form of words, numbers, codes,
patterns, symbols or some other form, expressed in a form that
readable by a machine, and which operate it to achieve a specific
goal or result. This concept covers both the operating system
and the application program expressed in output or object code,
including preparatory materials and audiovisual images resulting from the development of a computer program. The concept of “computer program” does not apply to the concept of “database”;
publication of a work is an action that makes the work
available to the public, no matter how this is achieved;
publication (release of a work) is the release into circulation of copies of a work or phonogram with the consent of the author or other person who has copyright and related rights, in an amount which satisfies the reasonable needs of the public by sale, rental, public rental, or other transfer of ownership or right of possession of a copy of a work or phonogram. Publication also means providing access to a work or phonogram through electronic information systems;
the person who has copyright and related rights isauthor or performer in cases where the author
or performer, as well as the individual or legal entity to whom the property rights were
were transferred; a derivative work is a product of intellectual creativity based on another existing work (translation, adaptation, reworking, etc.). Its originality lies either in the creative reworking of a work that existed before, or in the creative translation of it into another language;

=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=

So, firstly, the rights of authors (and the persons to whom they have delegated rights) are protected. Secondly, it does not matter in what way the work was published, it is important that it was done with the consent of the author...
So think about who acted according to the law, and therefore whose rights will be
protected by the Law...

Sincerely, George

Everything is clear, I’ll go and show the pirate the extracts from the law, fold them into four and
put them in my pocket... That’s all that is available to us. Slava, of course, will not sue, and we, it seems, are an uninterested person, and we don’t have the money for all
this red tape :(
Wow, I’m definitely ready to punch people in the face! :) If only this method would lead to anything... But I don’t believe in it.

Since Slava finally decided to switch to the PC, she was born phrase:

“I only hate PC because Vyacheslav Mednonogov went there...”

A-A-A-A-A-A-A-A!!!!!!!!!!!!!!!

To be honest, I want to fold my arms :(

Sorry.

Warm greetings, Slava!

Better in person.

From Eugene Safronov To All 2 April 1998

I am writing:
As far as you remember, this Dima brought a disk with a magazine from you. By that time, rumors had already begun to reach us that in Lugansk there was a broken
version of the ChV. Considering this Dima an honest person (and at first glance he turned out to be just that:(( ) we asked him to find out more about this. He naturally
promised us this, so we parted on pretty good terms.
After some time (a week/two) a guy comes up to us and reports that Alos (the thief) was offered a broken CV for 40g. He didn’t take it - he said expensive.
When this guy described to us a man who was offering a broken CV, suspicions immediately arose - he was very similar to Dima, who promised us to find out about the fate of the broken CV.
A couple of markets later, this person was seen standing next to Alos (the thief) and he did not approach us - this already left a bad taste in his soul. (the thief) puts up for sale the hacked version of
ChV. Since then, Dima has not appeared on the market (and if he does appear, he bypasses us from
the other side of the market, which in itself would be strange if he had not been involved in anything).
Draw your own conclusions :((

Well, packaged, Stanley, packaged!

Unfortunately, there is also your fault (and not so small :( ), but about
this Dima you are right - for his cutlets, for soap, etc., etc., but if you can
